YARRA BEND GOLF COURSE Terms and Conditions
Yarra Bend Golf Public Golf Course - Terms and ConditionsThese terms and conditions govern the use of Yarra Bend Golf Public Golf Course (referred to as "the Course"). By accessing and using the Course, you agree to comply with these terms and conditions. 1. Booking and Reservations:
1.1. All bookings must be made in advance through the official booking software, as determined by the Course from time to time.
1.2. Bookings will be accepted 15 days in advance and are subject to availability.
2.Fees, Payments, and Cancellations:
2.1. To secure a reservation, patrons are required to pay the applicable fees, with complete and accurate contact information.
2.2. The Course reserves the unrestricted right to determine fees. The Course reserves an unrestricted right to vary these fees, exercisable at its sole discretion, without prior notice.
2.3. Payments must be made in the prescribed manner and within the specified time frame.
2.4. Cancellations made 48 hours or more before the scheduled tee-off time will be eligible for a full refund.
2.5. Cancellations made between 24 and 48 hours from the booking time will receive a credit to the value of the original booking.
2.6. Cancellations made within 24 hours of the booking are deemed forfeited, and no refund or credit will be issued.
2.7. Yarra Bend Golf is a cashless facility. Accepted methods of payment include Visa and Mastercard.
3. Code of Conduct:
3.1. Patrons must adhere to the Course's code of conduct at all times.
3.2. Respectful and responsible behaviour is expected from all patrons.
3.3. Inappropriate behaviour, including offensive language, harassment, or vandalism, may result in revocation of facility access.
4. Dress Code:
4.1. Formal golf attire is not required.
4.2. The Course requires all patrons to adhere to the Course Code of Conduct when choosing their attire. Outfitting that displays inappropriate or offensive material, or is otherwise unsuitable for a family-friendly environment may result in revocation of facility access.
5. Safety and Security:
5.1. Patrons are expected to prioritise safety and follow all Course safety guidelines.
5.2. Any safety concerns must be reported to Course staff immediately.
6. Equipment:
6.1. All patrons using the Course must have their own set of golf clubs.
6.2. Rental equipment may be available, subject to availability.
6.3. Patrons who elect to hire equipment i.e. motorised golf carts or hire sets will be required to read, accurately complete, and sign a document acknowledging liability in the event items hired are damaged. As such, patrons assume full and absolute responsibility for equipment they opt to hire.
7. Course Regulations:
7.1. Patrons must follow all Course regulations and signage.
7.2. Any damage to Course property must be reported to Course staff immediately.
8. Weather Conditions:
8.1. The Course may be closed or restricted during adverse weather conditions. All patrons must comply with the Courses’ instructions during such weather events.
8.2. In consideration of T/C 2, patrons are encouraged to check for weather-related updates prior to booking.
8.3. Golf is an outdoor sport. As such, on occasions, the Course will remain open and playable, despite adverse weather conditions i.e. heat or rain.
8.4. The Course aims to ensure all patrons enjoy their experience and will therefore attempt to accommodate patrons who, having provided sufficient notice in accordance with the Course’s cancellation policies, may wish to alter their booking as a consequence of severe weather conditions. The Course reserves an unrestricted right to exercise its sole discretion in such instances.
8.5. Patrons are encouraged to check for weather-related updates and closures before arriving.
9. Liability:
9.1 To the maximum extent permitted by law, Yarra Bend Golf, its directors, officers and employees are not liable (whether in contract, tort including negligence, under statute or otherwise) for any loss, liability, cost, damage, expense or claim (including loss of profit or revenue, loss of use, legal costs and defence or settlement costs) arising under or in connection with the use of the golf course, driving range, adventure golf, or any other goods or services or amenities provided by or on behalf of Yarra Bend Golf.
9.2 Yarra Bend Golf’s liability for a guarantee or warranty implied by law or otherwise, and which cannot be excluded, is limited to the maximum extent the law allows to the replacement, re- supply or repair of the relevant goods or services.
9.3 Yarra Bend Golf will not be held responsible for any damages to, loss or theft of a patron or member's personal property.
Australian Consumer Law Warranty
Our goods and services come with guarantees that cannot be excluded under Australian consumer law. You are entitled to a refund or replacement for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
10. Risk
10.1 Playing (including practising) the game of golf and being in the vicinity of it has its risks — utilising the facility you accept all of the inherent and obvious risks from being on the Yarra Bend Golf grounds, and voluntarily assume all of those risks, whether or not described in this agreement. You acknowledge and agree that such risks include (but are not limited to):
a) Being hit by a golf ball or other golf equipment.
b) Slipping and / or falling on a wet or slippery surface.
c) Being injured by falling tree limbs or other flying debris.
d) Being exposed to the sun, rain, wind or storm without any protection from the elements.
e) Being exposed to wildlife i.e. snakes.
11. Changes to Terms and Conditions:
11.1 The Course reserves the right to update or modify these terms and conditions at any time.
By using the Course, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. Failure to comply with these terms may result in the suspension of access to the Course.
